WHY DO I NEED TO USE A SOLICITOR?

Buying a property can be a minefield and the one person, possibly above all others, you definitely need on your side is your Solicitor. They are highly trained individuals who know all the pitfalls which can arise when completing the sale of a property and they are there to advise and guide you throughout the entire process. It is folly to believe that all you have to do is find the perfect property and agree a purchase price. This is only the starting point.

If you are looking for a Solicitor to represent you in the buying or selling of a property, we can recommend a solictor for our panel. Solicitor usually offer full conveyancing services plus a wide range of other legal services. They are aware that you, the client, are sometimes baffled by all the technical jargon which can surround the sale or purchase of property and take time to ensure that you are fully aware of what is happening at each step. They believe that by keeping you informed, the whole process will progress that much more smoothly.

When you are buying a property, they will communicate with the Seller’s Solicitor and ascertain exactly what is included in the agreed price. It is not unusual for an agreed sale price to change because it did not take into account fixtures or fittings. These are the items which all too often the buyer believes were included in the price and the Seller believes were not included. Clarification of these details by your Solicitor will prevent delays and ensure that both parties are in agreement.

A number of other very important enquiries will be made by your Solicitor. One of these will be the local authority search. This asks the authority about the things like road access, plans for future road schemes, planning permissions and a host of other questions. Once again, these questions are asked in order to protect your interests. Nothing could be worse than to move into your dream home and find that there was a motorway development due to be started in six months time.

The Vendor’s Solicitor will draw up draft contracts and send these to your Solicitor for them to study and return as agreed or with further questions. In fairness the entire operation is more complex than we have made it sound here and it does require meticulous attention to detail and a very keen knowledge of the laws regarding conveyancing. Your Solicitor will also deal with the legal aspects of your mortgage arrangements whether acting for the Seller or the Buyer.

As you can see there is a great deal more to buying and selling a house than may at first be thought and there are also a large number of areas which need the expert attention of a Solicitor.
